It is not rare nowadays that married couples may not want to end up in Court Proceedings for getting divorced or having their rights and assets divided, but they look forward to a "friendly" voluntary agreement as to children and property.
Such agreements are recommended to be formalized and their provisions to be incorporated into a Separation Agreement, or into a deed of separation as may be called in different circumstances or jurisdictions.
However, it is crucial to be noted that, according to Cyprus law, Separation Agreements do not constitute a substitute of Court Divorce Orders. They can only be used as supporting evidence during Custody procedures, or during Matrimonial Property and Financial arrangements procedures before a court.
